The rancher Isaac Aaron and the logger Claudio da Silva Fernandes were sentenced on Wednesday (19), by the practice of slave labor on a farm in the municipality of Ulianópolis, Northeastern Pará. The first was punished with four years in prison, and the second, with three years as sentence signed by federal judge Rubens Rollo D’oliveira, the third rod, specialized in criminal actions trial.
The rancher was deprivation of liberty replaced with two penalty, each equivalent to ten minimum wages, a total of $ 12,440 .00. This value should be used to buy perishable foods and medicines that will be donated to charities later indicated by the Federal Court. Cláudio Fernandes also had their sentences replaced by two penalty, but on the value of minimum five each. Both defendants can still appeal to the Federal Court of the 1st region, in Brasilia (DF).
According to the complaint from the Federal Public Ministry (MPF), the practice has been constada in the act occurred between days 20 and January 27, 2005, the farm Colony, owned by Aaron. The occurrence of the crime was confirmed by special mobile enforcement group, comprising federal delegate, Attorney of the Ministry of labor, Federal Police and tax agents.
Electoral workers to develop activities of the farm of juquira and construction of about were sheltered, according to prosecutors, in huts built with tarpaulins and wooden logs. The victims, adds the report, had no access to sanitary facilities and made their physiological needs in the Bush. Without any protection, were exposed to rainfall and attacks by venomous animals. Drinking water was removed from the Grass Creek and also used in the preparation of food and personal hygiene.
Exploitation- According to the indictment of the MPF, foodstuffs and essential work tools were sold to employees over and above the prices practiced in local trade. With this, the workers, at the end of the service, were always in debt and prevented from leaving the farm. The victims also were not officially registered, were lured by the region’s pension owners and, on the farm, were under the surveillance of armed men, who will not let go.
“I have no doubt that, being the owner of the farm Colony, the defendant is not given that did not know the environment of insecurity experienced by workers and established for monitoring. Either they ignore the way the workers were hired through “cats” for the said property. Moreover, it is not credible, or leverages to innocence of the defendant, the supposed ignorance regarding the obligation to meet the basic labor rights and social workers were denied found on the farm, “says judge Rubens Rollo.
As the Claudius Fernandes, the sentence says that he himself admitted in court that he raised rural workers, in the municipality of Paragominas, carrying them in his truck to the farm Colony. Soon, according to the judge, played in such circumstances the activity of commonly called “cats”.
“It is incontrovertible fact that the defendant hired and transported, in his truck, workers later found surveillance, working in inhumane conditions at the farm. Contrary to the defense, there’s no denying, for Claudio Fernandes, the authorship of the crime “, reinforces Rubens Rollo.
