Brasilia-the Federal Court considered that the environmental licensing for the construction of the Belo Monte dam on the Xingu River, has met all environmental requirements. With the decision, even at first instance, is ensured the legality of release for plant construction.

The Federal Public Ministry (MPF) has requested the cancellation of licence of the Brazilian Institute of environment and renewable natural resources (Ibama), claiming that the work would affect indigenous lands of Paquiçamba, the Macaw Back Great and Juruna. For the organ, the activity of the plant would decrease the possibility of navigation on the Xingu River, fisheries and rituals of the indigenous communities and the Riverside region.

The Solicitor-General of the Union (AGU) argued that were established in the study and Environmental impact report (EIA/Rima) protective and compensatory measures to minimize impacts on the traditional way of life of the population. According to AGU, Ibama has established rules for monitoring the hydrological cycle, the seasonal variations and the behavior of native fish species to avoid losses of major proportions to the hydrological resources of the region.

The MPF has 30 days to appeal the decision, but reports that is analyzing the measures that will be taken.
